Regulation Division
Regulation Division is responsible for performing the following regulatory functions in terms of the Mineral and Petroleum Resources Development Act, 2002 (Act No.28 of 2002) (MPRDA) and the National Environmental Management Act, 1998 (Act No.107 of 1998) (NEMA):
Receive, process applications for different types of permits/rights and make recommendations to the Minister of Mineral Resources;
Ensure that permit/right holders comply with the law, including terms and conditions of the granted permits/rights;
Promote economic growth and petroleum resource development (Optimal exploration and production);
Ensure that production right holders contribute to socio-economic development (Social and Labour Plans and empowerment);
Assist the applicants in interpreting relevant legislation governing the upstream oil and gas industry;
Provide oil and gas policy proposals to the relevant Ministers;
Give effect to section 2d of the MPRDA by advancing/ensuring transformation; and
Give effect to section 24 of the Constitution by ensuring development of petroleum resources in an orderly and ecologically sustainable manner.
Regulation Division comprises of the following three departments:
Licensing and Legal Compliance – This department is responsible for licensing, legal compliance, negotiations of contracts, including social and labour plans, monitoring and enforcement of compliance with the social and labour plan.
Technical Compliance – This department is responsible for assessing proposed technical studies/exploration and production work programmes, technical and financial ability of the applicant and ensuring compliance and enforcement of the approved work programme.
Environmental Compliance – This department is responsible for assessing and making recommendation on Environmental Authorisation applications, ensuring compliance and enforcement of NEMA, any other relevant environmental legislation and approved Environmental Authorisation.
